When you create an account, you will be prompted to review the Privacy and Cookie Policy. Our Privacy and Cookie Policy is available in the footer of Our site.

“Account”	means an account required to access and/or use certain areas and features of OurSite, including Our Marketplace;

“Cookie Law”	means the relevant parts of the Privacy and Electronic Communications (EC Directive) Regulations 2003;
“Buyer”	means a User who makes a purchase on Our Marketplace;
“Seller”	means a User who sells holiday accommodation to rent/hire, on Our Marketplace;
“Our Site”	means this website, www.bookmycaravan.com;
“Listing”	means a listing on Our Marketplace advertising holiday accommodation to rent/ hire.
“personal data”	means any and all data that relates to an identifiable person who can be directly or indirectly identified from that data, as defined by UK General Data Protection Regulation (UK GDPR), as supplemented by the Data Protection Act 2018.
“We/Us/Our”	means Book My Caravan Ltd, a limited company registered in England under company number 14288299, whose registered address is at Unit 13 Independence House, Millfield Lane, Nether Poppleton, York, YO26 6PH.

This Privacy and Cookie Policy applies only to your use of Our Site. Our Site may contain links to other websites, and social media accounts. Please note that we have no control over how your data is collected, stored, or used by other websites and we advise you to check the privacy policies of any such websites before providing any data to them.

4. What Is Personal Data?

Personal data is defined by the General Data Protection Regulation UK General Data Protection Regulation (UK GDPR), as supplemented by the Data Protection Act 2018 (collectively, “the Data Protection Legislation”) as ‘any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier’.

Personal data is, in simpler terms, any information about you that enables you to be identified. Personal data covers obvious information such as your name and contact details, but it also covers less obvious information such as identification numbers, electronic location data, and other online identifiers.

We may use content contained within reviews that are left publicly on Our Site or on third party sites to promote Our Site. This is not personal information, as it is publicly available, so is not subject to this Privacy and Cookie Policy.

5. What Are My Rights?

Under the Data Protection Legislation, you have the following rights, which we will always work to uphold:

1. The right to be informed about our collection and use of your personal data. This Privacy and Cookie Policy should tell you everything you need to know, but you can always contact us to find out more or to ask any questions using the details in Part 15.

4. The right to be forgotten, i.e. the right to ask us to delete or otherwise dispose of any of your personal data that we hold. We reserve the right to hold your personal data until all contractual and legal obligations are satisfied. Please contact us using the details in Part 15 to find out more. 
5. The right to restrict (i.e. prevent) the processing of your personal data.
6. The right to object to us using your personal data for a particular purpose or purposes.
7. The right to withdraw consent. This means that, if we are relying on your consent as the legal basis for using your personal data, you are free to withdraw that consent at any time.
8. The right to data portability. This means that, if you have provided personal data to us directly, we are using it with your consent or for the performance of a contract, and that data is processed using automated means, you can ask us for a copy of that personal data to re-use with another service or business in many cases.
9. Rights relating to automated decision-making and profiling. We do not use your personal data in this way.

It is important that your personal data is kept accurate and up-to-date. If any of the personal data we hold about you changes, please keep us informed for as long as we have that data.

If you have any cause for complaint about our use of your personal data, you have the right to lodge a complaint with the Information Commissioner’s Office. We would welcome the opportunity to resolve your concerns ourselves, however, so please contact us first, using the details in Part 15.

6. What Data Do You Collect and How?

Depending upon your use of Our Site, we may collect and hold some or all of the personal data set out below, using the methods also set out below. Please also see Part 14 for more information about our use of Cookies and similar technologies.  We do not collect any ‘special category’ or ‘sensitive’ personal dataorpersonal data relating to childrenordata relating to criminal convictions and/or offences.

Data We Can Collect from Buyers and How?

Personal information data including but not limited to the following:

First name, last name, date of birth, telephone number/s, email address, postal address, gender, password recovery information, customer account number.

All personal information data will be collected when a Buyer creates an account and/or completes a transaction through Our Site. 

Financial data, which will be collected by our third party payment provider, Stripe, Inc.

All financial data will be collected when a Buyer completes a transaction through Our Site. 

Data We Can Collect from Sellers and How?

Personal information data including but not limited to the following:

First name, last name, date of birth, telephone number/s, email address, postal address, business address, business name, website address, password recovery information, supplier account number, photographs and/ or videos used to create the Sellers Account on Our Site and also the Sellers Listing on Our Site to promote and try take bookings for the holiday accommodation that they have listed for hire through Our Site. 

All personal information data will be collected when a Seller applies to be listed on Our Site. 

It is the Sellers duty to ensure that all personal data is kept up to date at all times. 

Financial data including but not limited to the following:

Bank data on the Host Dashboard Page for payouts for any bookings.

All financial data will be collected when a Seller applies to be listed on Our Site. 

It is the Seller’s duty to ensure that they have all necessary permissions and rights when they submit any material/information to Our Site, including photographs and videos, and that any such material including/showing minors, has the consent of the individual shown, to be included for marketing purposes. 

The Seller accepts that they are solely responsible for any disputes or potential legal disputes and/or claims that arise from the submission of material to Our Site. 

7. How Do You Use My Personal Data?

Under the Data Protection Legislation, we must always have a lawful basis for using personal data. The following information describes how we may use your personal data, and our lawful bases for doing so:

Buyers Personal Data:

When the Buyer creates an account on Our Site, they will have to supply some of the following information (as described in Section 6): 

First name, last name, date of birth, telephone number/s, email address, postal address, gender, password recovery information, customer account number, social media username.

The Buyer accepts that we may use the data listed above to register them on Our Site, to provide and manage their account, provide and manage access to Our Site, to communicate with/contact the Buyer, personalising and tailoring their experience on Our Site, managing payments for Our Site, via our third party payment provider, Stripe, Inc., personalizing and tailoring your experience, administering the Site, and providing our services. The Buyer also accepts that the data listed above will be passed on to the relevant Seller for any booking they make.

Our Lawful Basis for using the above listed personal data is to allow the Buyers to be able to create an account to make their experience of using Our Site a better experience as well as allowing the Buyer to make any bookings once they have chosen their desired holiday accommodation.

When the Buyer makes a booking/ completes a transaction, they will have to supply some of the following information (as described in Section 6): 

First name, last name, date of birth, telephone number/s, email address, postal address, gender, password recovery information, customer account number, booking reference number, social media username, and payment details, via our third party payment provider, Stripe, Inc.

The Buyer accepts that we may use the data listed above to allow them to complete a booking/ transaction. The Buyer accepts that if they choose to save their payment details when making a booking then Our Third Party Payment Provider will save these details to potentially apply for any remaining balance for existing bookings in line with these Terms of Use and the Terms for Buyers and also to allow a quicker booking experience for any future transactions. The Buyer also accepts that the data listed above, other than the payment details will be passed on to the relevant Seller for any booking they make. Where possible, we will use your email address to contact you to provide you with reminders and updates regarding your bookings and payments relating to your bookings. All payment details are stored through Our third party payment provider, which is Stripe, Inc. Stripe is PCI compliant, which means that your payment details are kept secure, and neither Us nor the Seller has access to those payment details. 

Our Lawful Basis for using the above listed personal data is to allow the Buyers to be able to create an account allowing the Buyer to make any bookings once they have chosen their desired holiday accommodation.

If the Buyer chooses to sign up for Our newsletter, then the Buyer will be requested to provide their name and email address. This is required to provide the newsletter to the Buyer. The newsletter will contain information such as details on Our offers, promotions, and new suppliers. Our Lawful Basis is consent, and you can retract your consent at any time.

Sellers’ Personal Data:

When the Seller applies to list their business on Our Site, they will have to supply some of the following information (as described in Section 6): 

First name, last name, date of birth, telephone number/s, email address, postal address, business address, business name, password recovery information, Seller account number, photographs and/or videos used to advertise the Sellers work/service on Our Site, and payment details. 

The Seller accepts that we may use the data listed above to register them on Our Site, to provide and manage their account, provide and manage access to Our Site, to communicate with/contact the Seller, personalising and tailoring their experience on Our Site, managing payments for Our Site, personalising and tailoring Our Site, administrating Our Site, supplying Our Site. The Seller also accepts that any of the data listed above that may be visible to Buyers/Users. The Sellers accept that by providing their contact information the Buyers/Users may use this information to get in direct contact with them.

All payment details are stored through Our third party payment provider, which is Stripe, Inc. Stripe is PCI compliant, which means that your payment details are kept secure, and We do not have access to those payment details.

Our Lawful Basis for using the above listed personal data is to allow the Sellers to be able to list their business on Our Site and advertise their business to any Users/ Buyers using Our Site to enhance the chance of taking bookings for their holiday accommodation.

As described in Section 6, it is the Seller’s duty to ensure that they have all necessary permissions and rights when they submit any material/information to Our Site, including photographs and videos, and that any such material including/showing minors, has the consent of the individual shown, to be included for marketing purposes. 

The Seller accepts that they are solely responsible for any disputes or potential legal disputes and/or claims that arise from the submission of material to Our Site. 

For Sellers and Buyers, the following information applies:

With your permission and/or where permitted by law, we may also use your personal data for marketing purposes, which may include contacting you by email,telephone, text messageorpost with information, news, and offers on our services. You will not be sent any unlawful marketing or spam. We will always work to fully protect your rights and comply with our obligations under the Data Protection Legislation and the Privacy and Electronic Communications (EC Directive) Regulations 2003, and you will always have the opportunity to opt-out. Wewill always obtain your express opt-in consent before sharing your personal data with third parties for marketing purposes and you will be able to opt-out at any time.

Third Parties include all businesses (Sellers) listed on Our Site and whose content appears on Our Site, may use third-party Cookies, as detailed below in Part 14. Please refer to Part 14 for more information on controlling cookies. Please note that we do not control the activities of such third parties, nor the data that they collect and use themselves, and we advise Buyers to check the privacy policies of any such third parties. Sellers accept that they are classed as a third-party on Our Site and if they have their own cookie policy/Privacy and Cookie Policy, it is recommended that these policies are include on the Sellers website.

We will only use your personal data for the purpose(s) for which it was originally collected unless we reasonably believe that another purpose is compatible with that or those original purpose(s) and need to use your personal data for that purpose. If we do use your personal data in this way and you wish us to explain how the new purpose is compatible with the original, please contact us using the details in Part 15.

If we need to use your personal data for a purpose that is unrelated to, or incompatible with, the purpose(s) for which it was originally collected, we will inform you and explain the legal basis which allows us to do so. 

In some circumstances, where permitted or required by law, we may process your personal data without your knowledge or consent. This will only be done within the bounds of the Data Protection Legislation and your legal rights.

Messaging on Our Site

We offer a direct messaging service on Our Site, which allows Buyers and Sellers to message each other directly. These conversations will be saved in each of your Accounts. We cannot guarantee that these messages will be stored indefinitely.

Our lawful basis for providing this functionality, and storing your messages, is the legitimate interest, which is to allow Buyers and Sellers to get the most out of Our Site, by being able to communicate directly with each other.

8. How Long Will You Keep My Personal Data?

We will not keep your personal data for any longer than is necessary in light of the reason(s) for which it was first collected. 

All Sellers personal data will therefore be kept whilst they have an account on Our Site, If the Seller wishes to delete their account at any time, they are able to do this, however, any data may be kept if the Seller has any ongoing or incomplete bookings with Buyers, through Our Site. This could be slightly longer if there are any legal or contractual obligations, and could be up to 7 years for Sellers’ personal data. For financial data, this information will only be kept with our payment provider, Stripe, Inc. on Our Site. If the Seller decides to remove their account from Our Site, it is their duty to ensure that any bookings made through Our Site are honoured. 

All Buyers personal data will be kept for as long as they have an account on Our Site. If the Buyer wishes to delete their account at any time, they are able to do this, however, any data may be kept if the Buyer has any ongoing or incomplete bookings with Sellers, through Our Site. Sellers will still be able to contact Buyers using the information provided, until the date on which the transaction is complete, or the service has been carried out. For financial data, this information will only be kept on Our Site if the Buyer has chosen to save their payment details on Our Site. 

9. How and Where Do You Store or Transfer My Personal Data?

We will only store or transfer your personal datawithin the European Economic Area (the “EEA”). The EEA consists of all EU member states, plus Norway, Iceland, and Liechtenstein.  This means that your personal data will be fully protected under the Data Protection Legislation, GDPR, and/or to equivalent standards by law including, reliance on the adequacy decision as a ground for transferring data from the UK to the EEA following the UK/ EU withdrawal agreement.

10. Do You Share My Personal Data?

Wewill not share any of your personal data with any third parties for any purposes, subject to the following exceptions:

As set out in Part 7, by supplying information on Our Site, Buyers agree that their information will be shared with Sellers and Sellers agree that their information will be shared with Buyers, for the purpose of completing any transactions made through Our Site, and for the purposes of any enquiries that the Buyers or Sellers may have. 

If we sell, transfer, or merge parts of our business or assets, your personal data may be transferred to a third party. Any new owner of our business may continue to use your personal data in the same way(s) that we have used it, as specified in this Privacy and Cookie Policy.

In some limited circumstances, we may be legally required to share certain personal data, which might include yours, if we are involved in legal proceedings or complying with legal obligations, a court order, or the instructions of a government authority.

If any of your personal data is shared with a third party, as described above, we will take steps to ensure that your personal data is handled safely, securely, and in accordance with your rights, our obligations, and the third party’s obligations under the law, as described above in Part 9.

If any personal data is transferred outside of the EEA, we will take suitable steps in order to ensure that your personal data is treated just as safely and securely as it would be within the UK and under the Data Protection Legislation, as explained above in Part 9.

11. How Can I Control My Personal Data?
    1. In addition to your rights under the Data Protection Legislation, set out in Part 5, whenyou submit personal data via Our Site, you may be given options to restrict our use of your personal data. In particular, we aim to give you strong controls on our use of your data for direct marketing purposes (including the ability to opt-out of receiving emails from us which you may do by unsubscribing using the links provided in our emails,at the point of providing your details and by managing your Account).

You may also wish to sign up to one or more of the preference services operating in the UK: The Telephone Preference Service (“the TPS”), the Corporate Telephone Preference Service (“the CTPS”), and the Mailing Preference Service (“the MPS”). These may help to prevent you receiving unsolicited marketing. Please note, however, that these services will not prevent you from receiving marketing communications that you have consented to receiving.

12. Can I Withhold Information?

You may access certain areas of Our Site without providing any personal data at all. However, to use all features and functions available on Our Site you may be required to submit or allow for the collection of certain data.

13. How Can I Access My Personal Data?

If you want to know what personal data we have about you, you can ask us for details of that personal data and for a copy of it (where any such personal data is held). This is known as a “subject access request”.

All subject access requests should be made in writing and sent to the email or postal addresses shown in Part 15. 

There is not normally any charge for a subject access request. If your request is ‘manifestly unfounded or excessive’ (for example, if you make repetitive requests) a fee may be charged to cover our administrative costs in responding.

Wewill respond to your subject access request within one month of receiving it. Normally, we aim to provide a complete response, including a copy of your personal data within that time. In some cases, however, particularly if your request is more complex, more time may be required up to a maximum of three months from the date we receive your request, the permitted extension period under Article 12(3) of the UK GDPR is an additional two months, making a total response time of up to three months from the date of receipt. You will be kept fully informed of our progress.

We use cookies in accordance with the Privacy and Electronic Communications Regulations (implementing the EU Directive 2002/58/EC).

Cookies are small text files placed on your device when you visit our site and are used to make the users experience more efficient. We are able to store cookies on your computer where they are necessary for the operation of the site however, for non-essential cookies we need your permission.

We collect certain information from these cookies, and this includes information about your IP address, your location when you access the Website, the date and time you access the Website, the language you use and the type of browser you use.

We will email you to inform you if updates have been made, you should then review the updated Privacy and Cookie Policy and if you continue to use Our Site or list their offerings on Our Site by conduct, then the updated or amended terms will be considered agreed.
